Please read the general terms & conditions before you order at Tyroola.com.au. When you place the order, you automatically give acceptance to the general terms and conditions.

  • 1. Definitions
    • 1.1 Customer – stands for the individual, person, company or other body who place an order on the site www.tyroola.com.au.
    • 1.2 Homepage – www.tyroola.com.au
    • 1.3 Account – means what you will need to register to submit an order on this site.
    • 1.4 Business day – stands for the day except Saturday or Sunday, nor a public and/or bank holiday anywhere in Australia. Also referable with "working day".
    • 1.5 Confirmation of order – means our email to you where we accept your order.
    • 1.6 Customer information – Information we request from you to place an order.
    • 1.7 Order number – Gathered by you as a customer after completing your order, you will find it in your order confirmation. Whenever questions related to an order arise, this should be your reference.
    • 1.8 Tyroola – Tyroola International Pty Ltd and the activities in Australia
    • 1.9 Product – The product(s) which are ordered by a customer from Tyroola via the website or any other medium. Similar words, like goods or items also refer to this. Note that all words which are used in singular can also be used in plural and it also applies vice versa.

    Please note that as of October 1, 2024, the company's legal name has been changed from Tyroola Pty Ltd to Tyroola International Pty Ltd. References to "Tyroola Pty Ltd" in these Terms and Conditions shall be understood to refer to "Tyroola International Pty Ltd." This name change does not affect your rights under these Terms and Conditions or any agreements previously made with Tyroola Pty Ltd.

    Tyroola International Pty Ltd will hereafter be referred to as the Seller, Company, Tyroola, We or Our. These general terms and conditions are applicable to all contracts a customer (hereafter indicated as you, the customer, or purchaser) made with Tyroola by ordering a product from Tyroola.com.au. By ordering a product from this website, you accept the General Terms and Conditions.

  • 3. Orders and Customers

    All orders at Tyroola will be processed immediately, assuming you place your order on a business day. When placing an order, you accept Tyroola's General Terms and Conditions, and confirm that you are:
    - A resident in Australia
    - Legally authorized to make purchases with the selected payment account
    - Ordering Products to be delivered and/or fitted in Australia
    If any of the above is incorrect, please do not place an Order with this site. We reserve the right, in our sole discretion, and at any time, to refuse, reject, or cancel any order placed with us

    Referral discounts and programs offered by Tyroola, including the Mates Rates referral program, apply only to orders placed directly on www.tyroola.com.au . Orders placed through partner platforms or third-party websites, including but not limited to NRMA and Supercheap Auto (SCA), are not eligible for Mates Rates referral discounts or rewards.

  • 4. Prices

    All Our Prices include GST and any other applicable taxes (which will be charged at the current rate as shown on the website). Prices include delivery, unless otherwise stated on the Website. The prices are given in Australian dollars (AUD). We reserve the right to correct mistakes and or update information without prior notice. However, if the wrong price has been shown on a product you have already ordered, we will of course notify you and await your approval of the correct price before we process your order.

    • 4.1 Price Match and Promotional Discount Limitations
      Price match approvals are not valid in conjunction with any other promotional offers, voucher codes, referral credits, or additional discounts. Any order placed in breach of this condition may be cancelled or amended by Tyroola prior to fulfilment.

  • 5. Payment
    • 5.1 At the moment Tyroola offers the following payment methods: Credit Card (Visa, MasterCard), PayPal, ZipMoney and Afterpay. We reserve the right to not offer all payment methods. By submitting a credit or debit card number, you:
      (a) confirm that your use of the particular card is authorized and that all information that you submit is true and accurate; and
      (b) authorize us to charge to the card you tendered all amounts payable by you to us (including GST and any other applicable taxes) based on the Items you order.
    • 5.2 If we suspect that any order is fraudulent or involves stolen identity or payment information, we reserve the right to make any additional authenticity checks and to involve any authorities we deem fit.
    • 5.3 The payment methods of ZipMoney and Afterpay are offered and controlled by these companies themselves, we simply offer it as a payment option, although any issues or queries regarding installments should be directed to the correct company.
       
  • 6. Warranties and Guarantees
    • 6.1 Tyroola's FREE Road Hazard Protection, Tyroola Tyre Protect and all warranties provided by Tyroola and listed on this webpage apply in addition to any other rights to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law. Our liability to you under this agreement is otherwise limited as set out in clause 7.
    • 6.2 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
    1. to cancel your service contract with us; and
    2. to a refund for the unused portion, or to compensation for its reduced value
      You are also entitled to choose a refund or replacement for major failures with goods.
    • 6.3 If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
    • 6.4 You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
       
  • 7. Liability

    • 7.1 Without excluding, restricting or modifying the rights and remedies to which you may be entitled under these consumer guarantees provisions of the Australian Consumer Law or Tyroola's liabilities under those provisions:
    1. you acknowledge that this website is provided "as is" and that we do not make any warranty or representation as to the suitability of this website or a Product for any purpose;
    2. we exclude all other implied terms and warranties, whether statutory or otherwise, relating to the website or the subject matter of this agreement; and
    3. we will not be liable to you for indirect and consequential loss arising from or connected to this agreement in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.
    • 7.2 Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
       
  • 8. Delivery

    • 8.1 Products purchased at Tyroola can be delivered to
      1) your address
      2) your chosen fitting partner (if available) or
      3) another given address.
    • 8.2 Products are usually delivered in 3-5 business days from the time the product has left the warehouse, unless stated otherwise. However, due to unforeseen changes in purchasing volume, shipping times can fluctuate. We aim to notify you if we suspect that we cannot make the delivery in the estimated delivery time, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
    • 8.3 Delivery costs are based on the postal code of the delivery address and the tyre size. These costs will be added to the total order price which will be visible in the cart and can already be calculated in the product detail page.

    • 8.5 Where you select a fitting service through Tyroola, the advertised fitting price is inclusive of tyre fitting, balancing and disposal of old tyres where applicable. The fitting price is a bundled service fee and no partial refunds or credits apply where any component of the service is not utilised.

 

  • 9. Cancellation Notice

    If you request to cancel your order prior to shipment, a cancellation fee of $25 will be payable to cover courier cancellation fees and processing charges.
    In the case of Wheels/Rims orders a cancellation can only be accepted if the wheels have not already been prepared for shipment.  Once dispatched, no returns can be offered.

  • 10. Refunds and Returns

    You are entitled to request a return within 14 days from the delivery date.

    To initiate a return, please email support@tyroola.com.au with your name, order number, and reason for return. Our team will guide you through the next steps in line with the claims process outlined in clause 11.

    Returns are accepted for:

    • change of mind

    • incorrectly ordered products

    • other approved cases at Tyroola’s discretion

    Only unused tyres that have not been fitted or mounted onto a vehicle are eligible for return. Tyres must be in original, resalable condition

    If collection is arranged by Tyroola, tyres must be available at the agreed location and time. If collection cannot be completed as scheduled, additional charges may apply.

    Return shipping is at the customer’s cost unless agreed otherwise. A restocking fee of up to 15% of the total order value may apply.

    Once the returned tyres are received and inspected, we will process your refund (excluding freight costs) within 14 days. Refunds will be issued to the original payment method, unless otherwise agreed.

    To the extent permitted by law, associated costs (such as rental vehicles) are not reimbursed.

    11. Claims Process

    For all Goods or Services claims, Please send an email to support@tyroola.com.au with your name, order number and reason for return in order to request an RMA number. Once a claim is approved, payment processing may take up to 10 business days.

    Tyroola will send the claims forms and the return delivery labels you need. For approved claims, the customer will get the products replaced with an equivalent product and reimbursed for any additional expenses. 

    Tyroola will determine if your claim is eligible for remedy under the Consumer Guarantees, Tyroola Tyre Protect or any additional Guarantees or Warranties set out on this Webpage.

    If the claim is not approved, the delivery costs are not refunded and the customer is fully charged. Please note that the customer is responsible for the products until they have been received by Tyroola. Please make sure you pack the products carefully, so they do not get damaged when they are returned to Tyroola.

  • 12. Ownership Reservation

    All products remain property of Tyroola until the full payment has been received.

  • 13.  Product Information and Disclaimers
    • 13.1 Product Availability The products on our website are for sale; however, we reserve the right to make changes. If typographical errors, technical problems, or similar issues occur, we reserve the right to cancel incoming orders. If this happens, you will be contacted.

    • 13.2 Supplier Descriptions Product descriptions are primarily provided by our suppliers. While we strive for accuracy, Tyroola accepts no responsibility for discrepancies in these descriptions.

    • 13.3 Wheels or Rims Tyres are sold without wheels or rims, which are available as separate products. Images displaying wheels or rims are for illustrative purposes only. An example might be a tyre displayed under the “tyre menu” attached to a rim. The rim in this example is not included in the price or purchase.

    • 13.4 Image Accuracy Sometimes product images may differ from the actual product. For instance, tread patterns or other design elements may vary. Tyroola accepts no responsibility for variations between the product images and the actual products.

    • 13.5 Customer Responsibility Tyroola accepts no responsibility for any tyre equipment, including wheels or rims, that you, as a car owner, choose to use with your vehicle.

  • 14. Force Majeure

    We are not responsible for delays caused by Force Majeure events. Examples of such events are: natural disasters, war, strike, decisions from authorities, non-deliveries from suppliers, and circumstances beyond our control, that cannot have been foreseen. If events like this occur, which makes Tyroola unable to keep agreement/commitment;
    Tyroola will be released from the obligation to fulfill the contract/commitment.

  • 15. Changes in General Terms and Conditions

    We reserve the right to update and make changes in our General Terms and Conditions. Any changes or additions will be published at tyroola.com.au. Continued use of our webpage is considered as an approval of the potential changes.

  • 16. Declaration of invalidity

    If any of the clauses of these General Terms and Conditions, or an agreement is declared invalid or cannot be executed by court, the other parts of the General Terms and  Conditions remain valid. The clauses held invalid or cannot be executed will be replaced with the appropriate legal guidance, counseling and practice.

  • 17. Website Restrictions

    Any program or automated technology may not be used to browse, search, share, or download text and/or images and/or code from this website.

  • 18. Privacy Policy

    Please read our Privacy, which represents a part of our General Terms and Conditions. You will find our Privacy Policy here.

  • 19. Age of Tyres

    The majority of the tyres we offer are manufactured within 12-24 months of your purchase date. However, same as with any bricks and mortar stores, some sizes and brands can have older manufacturing dates. This is usually because tyres are purchased/imported in batches from the tyre suppliers, but not all sell as quickly as each other. We will always endeavour to check with our customers if the tyre available is more than 4 years since production.

    If a tyre is over 4 years of age, it will also be priced accordingly. If stock is marked as 'Clearance stock', the age of the tyres potentially could have an age greater than 4 years or are demo tyres.

  • 20. Clearance Tyres

    Products marked as clearance have been discounted and might include discontinued product lines, take-off tyres, and products older than Tyroola's recommended manufacturing date of 4 years. All tyres are unused/new products. Please note that clearance tyres may also include demo products.

    Condition Disclaimer:
    While all clearance tyres are unused/new products, some may have been used for demonstration purposes or may have minor cosmetic imperfections. Tyroola makes every effort to ensure that clearance tyres are in good condition, but customers should be aware that clearance tyres may have been mounted on rims or used for display purposes.

    Additional Information:
    If you are unsure about the condition of a particular clearance tyre or would like additional information, please contact our Support Team before purchase to avoid delays or unnecessary return fees.

    Return Policy:
    Clearance tyres are subject to the same return policy as regular tyres. However, customers should carefully inspect clearance tyres upon delivery and report any issues or discrepancies to our Support Team promptly.

    Limited Availability:
    Please note that clearance tyres are available in limited quantities and may be subject to availability. Prices and availability of clearance tyres are subject to change without notice.

    Warranty:
    Clearance tyres are covered by Tyroola's standard warranty policy, which provides protection against manufacturing defects. For more information about our warranty policy, please refer to section 6 (Warranties and Guarantees) of these terms and conditions.

  • 21. Tyres Left at Fitting Stations

    If a customer is unreachable for a month or more since the tyres have been delivered to the Fitting Station, the customer is forfeiting the tyres and may not be subject to a refund.

  • 22. Images

    Images are for illustration purposes only. Wheel rims are not included with the tyre, and actual tread may differ from images depicted.

  • 23. Inappropriate / Rude Behaviour to Staff

    If you, the customer, fitting partner, or any other individual involved with Tyroola or the purchase of tyres is inappropriate and rude to staff, you will forfeit all additional privileges, promotions and additional services other than the very basic purchase and delivery of tyres at full retail price. 

  • 24. Trademark Acknowledgments 

    All product names, logos, and brands displayed on this website are the property of their respective owners. Tyroola uses these trademarks solely to identify and describe products and services. The use of these trademarks does not imply endorsement, affiliation, or sponsorship by the trademark owners, unless explicitly stated.
